2. Representations about the vehicle
For each vehicle listed, the Seller represents and warrants that:
- The Seller is the sole legal and registered owner and holds a valid California Certificate of Title in the Seller’s own name.
- There is no existing lien, loan, security interest, or third-party claim against the vehicle that has not been disclosed and cleared before sale.
- The vehicle is not stolen, and the VIN has not been altered, removed, or tampered with.
- The odometer reading is accurate to the best of the Seller’s knowledge and has not been altered.
- All known material defects, prior accidents, flood or fire damage, frame damage, and branded-title history have been disclosed in writing.
- The vehicle has not been declared salvage, junk, or non-repairable unless that status is disclosed and the title reflects it.
- There is no active safety recall the Seller knows of that has not been disclosed.
3. Volume acknowledgment — the five-vehicle limit
California requires a dealer licence once a person sells more than a limited number of vehicles within a rolling twelve-month period. The commonly applied threshold is more than five vehicles in any twelve months. Selling above that without a licence is unlawful and can carry fines and criminal exposure.
The Seller acknowledges and agrees that:
- The Seller is responsible for tracking their own total vehicle sales, including sales made outside the Bysmillah platform.
- The period is a rolling twelve months, not a calendar year. Sales in one autumn and the following spring may fall within the same twelve-month window.
- Bysmillah will count and record the Seller’s completed sales on the platform, and will block further listings once the threshold is reached until the Seller provides a valid dealer licence.
- Registering a vehicle in the Seller’s own name before resale does not exempt the Seller from the licensing requirement if the vehicle was acquired for resale.
- If the Seller intends to operate at volume, the Seller will obtain a California dealer licence, and Bysmillah may assist with that process.
- The Seller will not evade the limit by listing vehicles under the name of a spouse, relative, friend, business entity, or any other person while remaining the true seller. Doing so is grounds for immediate and permanent removal from the platform, and may itself be unlawful.

4. Financing acknowledgment
The Seller acknowledges that by allowing a buyer to pay over time, the Seller is extending credit personally and is accepting the following:
- The Seller, not Bysmillah, carries the entire risk that the buyer fails to pay.
- Bysmillah does not guarantee payment, does not insure the transaction, and will not compensate the Seller for any loss.
- The Seller is responsible for collecting payments, keeping records, and taking any recovery action.
- A seller who extends credit frequently may become subject to consumer credit rules that carry their own disclosure obligations, and the Seller is responsible for their own compliance.
- The Seller will not charge interest, will not increase the agreed total price for late payment, and will not retain late charges, which belong to charity.
5. Tax and title responsibility
- The Seller is responsible for reporting income from vehicle sales to the appropriate tax authorities.
- The Seller is responsible for completing the transfer of title and for filing the DMV release of liability within the period required by law.
- The Seller is responsible for providing a valid smog certification where California law requires one on transfer, and understands the transfer may fail without it.
- Bysmillah does not collect, remit, or advise on sales, use, or income tax.
6. Conduct
- The Seller will not misrepresent a vehicle’s condition, history, or mileage.
- The Seller will not pressure a buyer or take advantage of a buyer’s language ability, inexperience, or financial distress.
- The Seller will not attempt to structure a transaction as a lease, rental, or return-and-forfeit arrangement while describing it as a sale.
- The Seller will grant reasonable forbearance to a buyer in genuine hardship before pursuing remedies.
- The Seller understands that breach of this section may result in removal from the platform.
6.1 Fair dealing and non-discrimination
The Seller may choose whether to sell to a particular buyer on ordinary commercial grounds, but may not refuse, price differently, or impose different terms on the basis of race, colour, national origin, ancestry, religion, sex, gender identity, sexual orientation, marital status, age, disability, familial status, military or veteran status, primary language, immigration status, or receipt of public assistance. This applies on a faith-oriented platform exactly as it does anywhere else. Bysmillah is open to buyers of any faith or none, and a seller who screens buyers by religion is acting unlawfully and will be removed.
- The Seller will apply the same criteria to every buyer and will keep a brief written note of the commercial reason for declining any buyer.
7. Declaration
I confirm that the above statements are true, that I have read and understood the volume limit, and that I accept responsibility for my own licensing and tax compliance.
